DESCRIPTION:In May\, the Centers for Medicare and Medicaid Services issued a Notice of Proposed Rulemaking\, “Ensuring Access to Medicaid Services.”  The 130-page proposed rules would establish access standards\, transparency for Medicaid payment rates to providers\, and set requirements regarding compensation percentages for wages for direct care workers in Home and Community Based Services including 1915c waivers\, personal care service\, among other things.  This CMS Fact Sheet describes the proposed rulemaking. \nCMS proposes to make the following changes to HCBS services including 1915c\, personal care services\, homemaker and home health aide services: \n\n“Establish a new strategy for oversight\, monitoring\, quality assurance\, and quality improvement for HCBS programs;\nStrengthen person‑centered service planning and incident management systems in HCBS;\nRequire states to establish grievance systems in FFS HCBS programs;\nRequire that at least 80% of Medicaid payments for personal care\, homemaker\, and home health aide services be spent on compensation for the direct care workforce (as opposed to administrative overhead or profit);\nRequire states to publish the average hourly rate paid to direct care workers delivering personal care\, home health aide\, and homemaker services;\nRequire states to establish an advisory group for interested parties to advise and consult on provider payment rates and direct compensation for direct care workers;\nRequire states to report on waiting lists in section 1915(c) waiver programs; service delivery timeliness for personal care\, homemaker and home health aide services; and a standardized set of HCBS quality measures; and\nPromote public transparency related to the administration of Medicaid‑covered HCBS through public reporting of quality\, performance\, and compliance measures.”\n\nWe are currently drafting ACCSES’s public comment\, but your insights\, experience\, and knowledge will be invaluable.  The public comment period closes on July 3\, 2023 and we encourage you also to submit a comment on how your organizations\, staff\, and the people you serve would be affected by this rulemaking.  This session will be led by Thomas Cook\, Chair of ACCSES’s Long Term Services and Supports Committee.  It is open to all ACCSES members.  Register for the Zoom event here.

DESCRIPTION:During the summer of 2021\, ACCSES invited Michael Odioso\, an Ohio attorney\, to join an ACCSES member call to discuss legislation under consideration\, and ultimately passed by the Ohio General Assembly\, that provided as follows: “Every two years\, the president of the senate and speaker of the house of representatives shall establish a joint committee to examine the activities of the state’s protection and advocacy system and client assistance program.”  That Joint Committee convened in December 2022\, and on April 11\, issued its recommendations.  Mike will be back with us to talk about the process and the resulting recommendations.  We anticipate a robust discussion regarding the role of protection and advocacy organizations in states beyond Ohio.  This event is only open to ACCSES members. \nRegister: Click here

DESCRIPTION:The Summit will include three days of discussion and meetings\, time for visiting and catching up\, and on the morning following the Summit\, even a tour of an ACCSES member site! \n\nSunday\, January 15 – State Association Meeting\nMonday\, January 16 – Sessions (includes breakfast and lunch) followed by Awards Reception and Dinner\nTuesday\, January 17 – Sessions (includes breakfast and lunch)\n\nAlthough the Summit officially ends at 5:30PM on Tuesday\, we have been graciously asked to extend an invitation to all of you to tour ACCSES member\, The Center for Habilitation (TCH) in Tempe\, on Wednesday morning\, January 18. TCH has even offered to provide transportation from the hotel to TCH and then from TCH either back to the hotel or to the Phoenix Sky Harbor Airport! The tour will depart Hyatt Place at 9:00 a.m.\, and it is expected to conclude around 11:00 a.m.
